1. COLLECTION OF INFORMATION

Account Credentials: Name, email address, and encrypted password.
Creative Input: Text prompts, style descriptors, color palettes, and “briefs” provided to our AI production pipelines.
Customer Support: Records of correspondence if you contact us for technical assistance.

Log and Usage Data: IP address, browser type, operating system, access times, and the specific pages viewed.
Device Information: Unique device identifiers and hardware model.

1.3 Information from Third-Party Integrations
Fungies Inc. (Merchant of Record): While Fungies processes your payment, they share certain transaction identifiers and billing status with us to manage your Elistit Pro subscription and Creative Credit balance.
Google Drive: When you authorize delivery, we receive a unique token allowing us to create folders and upload files to your designated Google Drive. We do not read or access any other files in your Drive.
Etsy: If you use our listing draft feature, we access your shop name and necessary API permissions to create drafts. We do not “scrape” Etsy's public marketplace data. Our interaction with Etsy is strictly limited to your authorized shop via the official Etsy API.
2. USE OF YOUR INFORMATION
We use the information we collect for the following business purposes:
Service Delivery: To run AI generation pipelines, upscale images to 300 DPI, and create your commercial assets.
Account Management: To track your Creative Credit usage and manage your Elistit Pro subscription status.
Technical Improvements: To train our internal processing algorithms (e.g., improving ratio-cropping accuracy) and optimize site performance.
Compliance: To verify identity, prevent fraudulent “bot” activity, and comply with tax and legal obligations.
Communications: To send you “Production Complete” notifications and critical service updates.
3. AI TRANSPARENCY & DATA USAGE
3.1 AI Generation Data
The creative directions you provide are processed by our proprietary pipelines and third-party AI models (e.g., hosted GPU clusters).
Training Disclosure: We do not sell your specific creative prompts to third parties for model training.
Automated Decision Making: Our AI tools assist in production but do not make “legal” or “significant” decisions about you. You retain final human oversight and must manually approve any output before publishing it to your Etsy shop.
4. DISCLOSURE OF YOUR INFORMATION
We do not sell, rent, or trade your Personal Information. We share data only in the following circumstances:
Merchant of Record (Fungies Inc.): We share necessary account identifiers with Fungies Inc. to facilitate secure payments, manage VAT/Sales Tax collection, and handle billing disputes.
Service Providers: We share data with hosting providers (e.g., AWS/Google Cloud) and analytics partners (e.g., Google Analytics, Microsoft Clarity) who are contractually bound to protect your data.
Legal Requirements: We may disclose information if required by law or to protect the rights, property, or safety of Your Brand Assistant LLC, our users, or the public.
5. ETSY COMPLIANCE & API USAGE
To ensure the long-term health of your Etsy shop and our platform:
Official API: Elistit only interacts with Etsy through the official Etsy API. We do not use unauthorized “crawlers” or “scrapers.”
Data Minimization: We only request the minimum permissions needed to create listing drafts.
User Control: You can revoke Elistit's access to your Etsy shop at any time via your Etsy “Apps” settings.
Trademark Notice: The term ‘Etsy’ is a trademark of Etsy, Inc. This Application uses Etsy's API but is not endorsed or certified by Etsy.
6. DATA RETENTION
We retain your Personal Information for as long as your account is active.
Asset History: We store your generated assets (Wall Art, Clipart) for a minimum of 90 days to ensure you have sufficient time to download them to your own storage.
Legal Records: Financial transaction data managed by Fungies Inc. is retained for up to 7 years to comply with global tax regulations.
7. SECURITY OF YOUR INFORMATION
We use administrative, technical, and physical security measures to help protect your personal information. This includes AES-256 encryption for data at rest and SSL/TLS encryption for data in transit. While we take every reasonable precaution, no data transmission over the internet can be guaranteed to be 100% secure.
8. YOUR PRIVACY RIGHTS (GDPR/CCPA/VCDPA)
Depending on your residency, you have the following rights:
Right to Know/Access: You can request a summary of the data we have collected.
Right to Deletion: You can request that we delete your account and all associated AI generation history.
Right to Data Portability: You can request your generated assets and SEO copy in a machine-readable format.
Right to Correction: You can update inaccurate profile information at any time.

9. INTERNATIONAL DATA TRANSFERS
Our servers are located in the United States. 10. COOKIE POLICY
We maintain a single, standalone Cookie Policy at /cookies, which governs our use of cookies, analytics technologies, and cookie controls.
